MINUTES <br />PLANNING COMMISSION <br />3/9/83 <br />Page 11 <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Wilson that approval of this prezoning would have no significant adverse <br />effect on the environment and therefore recommended approval of the <br />Negative Declaration prepared for case KZ-63-I. <br />ROLL CALL VOTE <br />AYtS: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />NOES: None <br />ABSENT: None <br />AfiSTA I N : None <br />Resolution No. 2281 was entered and adopted recommending approval of <br />the Negative Declaration prepared for case RZ-83-1. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner Wilson <br />that case RZ-83-1 be recommended for approval as recommended in the staff <br />report of 3/9/83. <br />ROLL CALL VUTE <br />AYES: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Kesolution No. 2262 was entered and adopted recommending approval of <br />case FcZ-63-1 as motioned. <br />MATTERS FOR COMMISSION'S REVIEW <br />Newspaper Dispensers <br />Mr. Harris presented the staff report stating that most of the items <br />listed would come under the Public Health and Safety Code and not the <br />Zoning Ordinance. He indicated that it is the staff's intention to submit <br />the information in the report for perusal and recommendation to the staff <br />on items the Commission would like to see adopted in an ordinance governing <br />dispensers. He stated everyone wasn't notified prior to this Planning <br />Commission meeting but would be when an ordinance is proposed for <br />consideration for public hearing. Further that the regulations would be <br />retroactive and not effective on their passage and adoption. He also <br />stated that encroachments permits currently are required for newspaper <br />dispensers on public property. <br />Commissioner Jamieson asked if other cities have these types of regulations. <br />Mr. Swift responded that the items listed for consideration came from <br />Alameda, Berkeley, Oakland and Los Angeles. <br />Chairperson Lindsey asked if the alternatives proposed are legally <br />defensible, Mr. Swift stated that, yes, they are as they were tested <br />in litigation in Los Angeles. <br />-ll- <br />
