PLANNING COMMISSION <br />Page 16 <br />4/13/83 <br />Chairperson Lindsey asked Mr. Bernard if he had any problems limiting <br />his hours. Mr. Bernard responded that he has no problem with <br />limiting his retail hours but did not wish his working hours <br />restricted when the need arises for him to work overtime. <br />The public hearing was closed. <br />A motion was made by Commissioner Getty, seconded by .Commissioner <br />Doherty that findings as shown in the staff report are made and <br />that case UP-83-7 be approved as recommended in the staff report. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, Getty, Jamieson, Wilson <br />and Chairperson Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2293 was entered and adopted approving case UP-83-7 <br />as motioned. <br />AP-83-5, City Council <br />Appeal of City Council of a decision of the Director of Planning <br />and Community Development approving a minor modification to an approved <br />development plan for a 32 unit townhouse project proposed for the <br />approximately two acre site located on the south side of Palomino <br />Drive between Pico Avenue and Concord Street. The proposed <br />modification involves a reduction in the number of bedrooms, <br />addition of a swimming pool and spa, minor architectural changes, <br />inclusion of refuse enclosures, delineation of emergency access, <br />and conversion of all proposed garages to carports. Zoning for <br />the property is PUD (Planned Unit Development)-High Density Residential <br />District. <br />Mr. Glenn presented the staff report recommending approval of <br />the modification requested by the applicant. <br />Commissioner Getty asked if there is a set amount of time for these <br />units to remain for rental purposes. Mr. Glenn stated he did not <br />get an indication of that. <br />The public hearing was opened. <br />Dana Owyoung, Jerry Loving Architects., Mt. Diablo Blvd., Walnut <br />Creek. Mr. Owyoung presented the three minor modifications requested <br />and presented color renderings. The changes requested are: between <br />Units No. 5 and 7 a spa and swimming pool area which would be <br />screened by a trellis and stucco fence; carports to be located in <br />locations previously approved for garages; and the development of <br />two bedroom units instead of three. <br />Chairperson Lindsey asked Mr. Owyoung why they want to have two <br />bedroom units instead of three. He explained it is based on the <br />marketability of the units and perhaps the proponent should address <br />this issue. <br />
