PLANNING COMMISSION <br />June 22, 1983 <br />Page Eight (revised 7/19/83) <br />MATTERS FOR COMMISSION'S REVIEW <br />Newspaper Dispenser Study <br />Mr. Harris reviewed the staff report regarding the progress <br />made by the Newsrack Committee. Because the staff and the <br />committee have reached an apparent impasse, it is suggested <br />that staff be directed to prepare a draft ordinance to regulate <br />the newracks and that the ordinance be prepared in conjunction <br />with suggestions from the Committee. <br />There was considerable discussion about the placement of news- <br />racks downtown as itemized in the letter from Nell Martin. <br />Also discussed was the question of moving the racks in the <br />event of a change in the business occupants near the present <br />locations. <br />Commissioner Getty indicated the real problem is the location <br />of racks in the residential areas. She also discussed the rack <br />at the Roundup Bar; what happens if the use changes? What <br />if it becomes a bank and the bank doesn't want the rack? Also, <br />she asked about the rack at the Cheese Factory and whether or <br />not the location could be modified because of the concern about <br />the stands. She said the present site faces the building and there <br />is a fire hydrant near it. It also causes parking interference <br />when you park near it. She indicated you cannot open your car <br />door in this situation. She wanted to know what recourse, if <br />any, is available. Mr. Harris indicated perhaps the ordinance <br />could require movement to an acceptable area nearby if the <br />business adjacent to it requests such a move. <br />Commissioner Getty believed that the Fire Department and store <br />owners should have something on record regarding locations. She <br />cited the. Cheese Factor where the sidewalks are not wide enough <br />for newsracks and pedestrians, <br />Mr. Swift indicated that if an encroachment Hermit were issued <br />it would be hard for a store owner to request that a rack be <br />moved inasmuch as they would be on public property, not private, <br />and would have permission to locate, He further indicated that <br />it was probably impossible to incorporate adjacent business <br />owners' approvals, but he would look into it. <br />Commissioner Arrigoni asked what the consensus on design and <br />aesthetics of the modules is. Mr. Harris indicated the modules <br />would be similar to the ones near the Carnation Restaurant with <br />provision to change at some future date.
