MINUTES <br />PLANNING COMMISSION <br />11/9/83 <br />Page 4 <br />Mike Niklaus, President, Capital Conveyance, 2101 J Street, Sacramento, understands there <br />were many concerns regarding the center in the past. He realizes the concerns of the neighbors <br />contiguous to the parcel under application. They acquired the shopping center in August <br />'83and have met with the City staff, building department, etc. concerning parking and <br />use of the parcel. He felt some of the concerns regarding the problems relating to parking <br />are real and some may be regulatory. He felt it would be a good idea to change the zoning <br />of both parcels to PUD as this would probably ameliorate the parking situation. He concurred <br />that restaurant use of the parcels is not appropriate for the center and that retail was <br />desirable. On 10/27/83 they met with the neighbors and explained their intentions to them. <br />He stated they will continue to meet with them in the process of development. They explained <br />the two processes to them, i.e., general plan amendment and then subsequent rezoning. <br />They concur with the staff report and also concurs that "Office District" would be appropriate <br />zoning and one they would be happy to live with. <br />Commissioner Getty asked the developer if they hoped the restaurants in the center wouldn't <br />last long. Mr. Niklaus said 'no,' it is their intention to not add additional restaurants in <br />the center. Commissioner Getty then asked the developer if it would be advantageous <br />to the present tenants to make all of the property under application all parking. Mr. Niklaus <br />said it would not be but parking could be utilized by both parcels. They can provide <br />additional parking for the center and have sufficient parking for office use. He felt that <br />in the interest of the neighbors some office would be appropriate for the parcel because <br />of noise and aesthetics. <br />Chairman Jamieson asked Mr. Niklaus why they wanted to add on to the center with the <br />existing structures only one-half occupied at the current time. Mr. Niklaus said they first <br />have to have a general plan change for the parcel, then rezone it and it could be well into <br />1984 or 1985 before any activity would take place on the parcel itself. He felt very confident <br />in the ability of Capital Conveyance to lease out their center. <br />Commissioner Lindsey asked about the second floor in the two-story structure and asked <br />what the intended use will be. Mr. Niklaus said it will probably be used as office. <br />Pat Mahoney, 2820 Longspur, stated the owners of the shopping center met with some of <br />the neighbors and there was a very good rapport. She said, however, she didn't receive <br />notice of this meeting until 7:20pm this evening. She indicated that the Pozzebons had <br />a notice stating the meeting was to be held November 8, 1983. She asked that this general <br />plan amendment be continued for proper notice to the neighbors. <br />Commissioner Lindsey asked Mrs. Mahoney about the meeting held with the developers <br />and how many people were in attendance. Mrs. Mahoney said there were four neighbors <br />at the meeting. Commissioner Lindsey pointed out that a general plan amendment is being <br />heard this evening and that there was no development plan submitted at this time. Mrs. <br />Mahoney said she knows this but this is the first time they have been made aware there <br />would be so much parking on the property. She said they are very aware of the parking <br />problems of the shopping center and that there has been a parking problem since day one. <br />Commissioner Wilson asked if there were two-thirds office and one-third parking if they <br />neighbors would be in accord. Mrs. Mahoney felt that the neighbors would be happiest <br />with perhaps a doctors office, etc. <br />Commissioner Doherty was very concerned about the alleged lack of offical notice to the <br />neighbors and supported a continuance for renotification. He then asked Mrs. Mahoney <br />how she found out about the meeting. She stated she found out about it through the Pozzebons. <br />Commissioner Doherty then asked Mrs. Mahoney the location of her home.
