MINUTES <br />PLANNING COMMISSION <br />November 21, 1983 <br />Page 8 <br />Mr. Swift reminded the Commission that if they chose to recommend <br />approval of the development agreement they will have to find that <br />it is in conformance with the General Plan and should refer to <br />the two agreements before them (one for Prudential and the other <br />for Callahan-Pentz Properties). <br />Commissioner Arrigoni asked who prepared the agreement. Mr. Swift <br />stated it is the work of attorneys for the City and developer <br />and is the result of six different drafts prepared. <br />Commissioner Lindsey felt the agreements would be beneficial to <br />the City of Pleasanton. He disagrees that the future cannot be <br />predicted and feels there are an abundance of controls to protect <br />the City. He supported the development agreements. <br />Commissioner Getty agreed with Commissioner Lindsey. She stated <br />there have been EIRs, CC&Rs and a development agreement just completes <br />the project. <br />Chairman Jamieson asked Mr. Swift if the City has any problems <br />with Page 12 of the agreement, specifically 2.1. Mr. Swift stated <br />that this particular paragraph is a typical clause and assures <br />that the development will build at the codes and regulations in <br />effect at the time the developer takes out a building permit and <br />not necessary the rules and regulations in effect now if the structures <br />are not built now. <br />Chairman Jamieson asked if the height limitation still prevails. <br />Mr. Swift stated that individual buildings still have to come <br />before the Planning and Commission and City Council for design <br />approval. He explained the various height limitations of the <br />various zoning districts. <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Arrigoni that the development agreement between the City of Pleasanton <br />and Prudential Insurance Company conforms with the general plan <br />of the City of Pleasanton and conforms to Government Code Section <br />65864 - 68569 and recommended that City Council approve the agreement. <br />ROLL CALL VOTE <br />AYES: Commissioners Arrigoni, Doherty, Getty, <br />Lindsey, and Chairman Jamieson <br />NOES: None <br />ABSENT: Commissioner Wilson <br />ABSTAIN: None <br />Resolution No. 2392 was entered and adopted recommending approval <br />of the development agreement between Prudential and the City of <br />Pleasanton as motioned. <br />-8- <br /> <br />
