MINUTES <br />PLANNING COMMISSION <br />November 28, 1983 <br />Page 3 <br />Commissioner Lindsey then asked Mr. Mahoney if he had a concern with rezoning <br />the property for an office use. Mr. Mahoney said he didn't as long as the parking <br />can be controlled. He felt the "P" zoned property served as a barrier and with <br />office use the parking lot probably wouldn't be used after 6:00-7:OOpm which <br />is what he prefers. <br />Commissioner Doherty stated that a limited access parking lot was discussed <br />a long time ago when the shopping center first got its approval and felt a limited <br />access parking lot would be in the best interest of the abutting homeowners. <br />Nancy Pozzebon, 2808 Longspur Drive, stated her home backs up to the "P" zoned <br />property. She stated the shopping center has a parking problem and was concerned <br />that the overflow would park on the 1.6 acre parcel next to her home. She said <br />the City previously decided they would protect the homeowners with a buffer. <br />She felt that it was not necessary to discuss this issue every two years. She <br />said she would like to work with Capital Conveyance Company and help them out <br />but wants the concerns of the homeowners to be taken into consideration. She <br />stated that the previous owners did not live up to their promises by planting <br />shrubs, etc. <br />Commissioner Lindsey informed Mrs. Pozzebon that no plan had yet been received <br />for the subject site and that when plans are received, a public hearing will <br />be held. Ms. Pozzebon said she is-aware of that. <br />Chairman Jamieson then asked Ms. Pozzebon if she preferred the "Public and Institutional" <br />land use designation over "Commercial and Offices." She stated they would object <br />to "Commercial." Commissioner Getty explained to Ms. Pozzebon that the general <br />plan does not have a straight "Office" designation but that it is called "Commercial <br />and Offices." She stated that the zoning would more precisely define the uses. <br />Commissioner Doherty stated that the developer probably intends to apply for <br />PUD zoning which would allow more conditions than under regular zoning. Setbacks, <br />uses, etc. would be more strictly controlled. However, the P-I land use designation <br />allows for a DMV, schools, parks. He indicated that DMV is at another location; <br />the School District has stated there isn't a need for more schools and he didn't <br />see the City rushing to build a park on the site. He felt controls can be put <br />on the property to alleviate the legitimate concerns of the neighbors. He <br />suspected that Capital Conveyance is making more of an effort that the previous <br />owners to work with the neighbors. Ms. Pozzebon agreed that they are making <br />more of an effort. <br />Chairman Jamieson inquired about the statement made earlier concerning limiting <br />the parking. He indicated he would like to have the record checked on this <br />item. <br />Commissioner Doherty felt that when Tam Investment applied for the shopping <br />center he believes there was discussion concerning limiting the hours of operation, <br />thereby controlling parking. <br />Pat Mahoney, 2128 Longspur, asked if a plan would have to be submitted before <br />restricting the parking. Commissioner. Doherty said this is correct. <br />Commissioner Wilson had real concerns about the 1.6 acre site being a separate <br />parcel and would like it included in the PUD zoning.
