City. The costs for the third examination will be shared <br /> by the employee and the City. The decision of the third <br /> physician concerning the ability of the employee to <br /> perform his /her duties shall be the basis for the employee <br /> returning to work. <br /> Section 28. Outside Employment <br /> Employees who plan to engage in regular employment during <br /> his /her off duty time must notify the Fire Chief of said <br /> employment. <br /> No employee shall accept outside employment that places <br /> him /her in conflict with the City. <br /> No employee shall solicit outside employment while on duty <br /> for the City nor use his /her City position as an aid or <br /> leverage to gain outside employment. <br /> Use of City equipment or City identification by signs, <br /> insignia or dress is permitted only while working for the <br /> City. <br /> Section 29. Documentation RE: Organized Mess <br /> The City shall provide the documentation required by the <br /> Internal Revenue Service for the deduction of the cost of <br /> meals taken as part of an organized mess established for <br /> the convenience of the City. <br /> Section 30. Miscellaneous <br /> 30.1 Modified Duty <br /> During the term of this agreement the Union agrees to meet <br /> with the City to discuss implementation of a modified duty <br /> policy. Said discussions shall not exceed six months <br /> duration. <br /> 30.2 FLSA Overtime Computation <br /> Representatives of the City and Union shall meet at a <br /> convenient time but prior to December 31, 1990, to discuss <br /> if hours of paid leave should be treated as hours worked <br /> in the computation of FLSA overtime payments. <br /> The City shall also obtain a written opinion from the law <br /> firm of Liebert, Cassidy and Frierson regarding this <br /> overtime computation issue. The Union shall be provided <br /> a copy of the opinion. <br /> - 27 - <br />
