be allowed on he property. This requires interpretation in the <br />zoning and land use designations. Staff has taken the position <br />that this use is residential in nature. He asked the Planning <br />Commission to determine that it is not residential in nature. He <br />stated that they have purchased 18.34 dues worth of sewer pemits <br />and have gotten them extended from year to year per the Stoneson <br />agreement. He said if the property is residential one cannot <br />purchase sufficient sewer to cover it. He stated the area would <br />be perfect for a retirement center because it is close to <br />transportation, medical facilities and shopping. <br />Commissioner Lindsey asked if these units would have kitchens in <br />them as would separate apartment units. Mr. Fraser indicated <br />there would be centralized dining and would probably just have a <br />hot plate and perhaps refrigerator in the units. Commissioner <br />Lindsey asked if later down the line the owner could convert the <br />units and rent them to anybody else. Mr. Fraser indicated that <br />the average age of a tenant would be 72 years. <br />Commissioner Innes asked if staff had checked with any other City <br />concerning this. Mr. Harris indicated no survey had been made. <br />Chairman Doherty asked about the zoning for Kottinger Place, <br />Pleasanton Greens, Pleasanton Gardens. Mr. Harris responded that <br />they are residentially zoned. Commissioner Getty indicated that <br />while they are residentially zoned, they don't provide meals. <br />Commissioner Wilson pointed out that people live in such <br />institutions as the Fairmount and Palace Hotels. <br />Mr. Harris stated that there are lots of areas in Pleasanton <br />right on the general plan for this type of use. <br />Commissioner Innes felt that the applicants were trying to get <br />around the General Plan. Mr. Harris felt that if this use is <br />allowed under the current land use designation the integrity of <br />the general plan would be compromised. <br />Commissioner Getty asked if this use were classified as a hotel <br />if they would have to pay a hotel tax. Mr. Harris stated he <br />didn't know. <br />Commissioner Wilson then discussed sewer capacity. Mr. Swift <br />indicated that developments had to live within their allocations. <br />The Commissioners then discussed the general plan and rezoning <br />change. <br />A motion was made by Commissioner Innes, seconded by Chairman <br />Doherty that the Commission concurs with the staff in that a <br />retirement center is residential in nature and that a land use <br />and zoning change would have to take place on the subject <br />property before such a facility could be approved. <br />- 20 - <br />
