and that case UP-84-47 be approved subject to the conditions <br />shown in the staff report. <br />ROLL CALL VOTE <br />AYES• Commissioners Getty, Innes, Lindsey, <br />• Wilson and Chairman Doherty <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2548 was entered and adopted approving case <br />UP-84-47 as motioned. <br />PUD-84-4, John Ferreri & Fred Miranda <br />Application of John Ferreri and Fred Miranda for PUD (Planned <br />Unit Development) zoning and development plan approval to <br />construct two medical office buildings totalling approximately <br />51,000 sq. ft. and a retail shopping center totalling <br />approximately 53,000 sq. ft. on an approximately 7.7 acre site <br />located southeast of the intersection of Santa Rita Road and West <br />Las Positas Boulevard adjacent to the Exxon Service Station. The <br />property is currently zoned PUD (Planned Unit <br />Development)-Commercial and Offices District. A negative <br />declaration of environmental impacts will also be considered. <br />Mr. Harris presented the staff report recommending approval. He <br />indicated that a Nob Hill Food market has expressed interest in <br />locating at this site. The development plan as currently <br />presented shows the project being phased. Staff is recommending <br />approval of the project but has reservations about the aesthetics <br />of the medical building. Commissioners Lindsey and Innes asked if <br />they could require the developer to come back with the design of <br />the medical building. Mr. Harris indicated that approval could <br />be so indicated. <br />The public hearing was opened. <br />John Ferreri, 865 Abbie Street, stated they have met with the <br />homeowners surrounding the project and have considered all of <br />their concerns. He apologized for not having met with Mr. Green, <br />the president of the homeowners association immediately across <br />the street from he project. He stated that they have talked to <br />Nob Hill and they have agreed to not having any deliveries after <br />10:00pm and before 6:OOam in response to concerns of neighbors. <br />They have relocated their trash facility back away from the <br />neighbors homes. They have also agreed to placing an eight ft. <br />high masonry wall running the full length of the eastern property <br />line. The neighbors have requested that this be one of the <br />first things to be constructed on the project and this has been <br />agreed to. <br />Mr. Ferreri stated that the neighbors do not want stores <br />operating all night. They have agreed to this. They havfastked <br />that no liquor stores, arcades, convenience foot stores, <br />food stores, etc. be allowed. They have agreed but would like <br />- 15 - <br />it <br />
