Commissioner Innes felt that if the entire green <br />area is eliminated some arrangement has to be made to handle the <br />drainage. It would take money to maintain the catch basins, <br />piping, etc. Mr. Gieger said he has paid those costs. He has <br />paid $70 for that area. <br />REBUTTAL <br />Mr. Lawrence indicated that he had talked to Mr. Collins about <br />this matter and they were in the process of getting signatures at <br />that time. Because the development covered two years, there were <br />varying circumstances concerning each of the properties. Some of <br />the people constructed their own fences, some had the contractor <br />do it. <br />Commissioner Getty stated that she has ridden her bike in the <br />area and can't find the open space. She felt that the matter <br />should be continued to allow the Planning Commission the time to <br />see the area so that a good decision can be made. This will also <br />allow staff time to look at the P.S.E requirements and the <br />flooding problems. Commissioners Innes and Wilson felt that to <br />continue the matter would be a good idea. <br />Commissioner Wilson stated they only flexibility there is is in <br />adjustment of easements. Mr. Warnick stated that the easements <br />cannot be shrunk too much. <br />Discussion then ensued concerning the next hearing date. Mr. <br />Harris pointed out that there is a swimming pool waiting to be <br />gunited. <br />Commissioner Wilson noted that there was no one present at this <br />hearing from the Mirador and Abbie Street areas. Mr. Harris <br />indicated that everyone has been sent notice. <br />Commissioner Lindsey asked if a pool could be allowed to continue <br />constructed. Mr. Harris stated that the City has given a building <br />permit for its construction but there is a stop work order on it. <br />Commissioner Getty felt that the surrounding neighbors of the <br />project made a decision for the residences of Old Towne which is <br />unfair. <br />Chairman Doherty asked where the property owner is who has the <br />swimming pool under construction. Mr. Powers stated that he is <br />on vacation and he expects the pool to be completed when he <br />returns. <br />Mr. Swift indicated that a PSE would have to be maintained <br />because it is for utilities and that Engineering and Planning <br />will have to get together to see what can be done with regard to <br />this matter. <br />Chairman Doherty, after conferring with the other Commissioners, <br />announced that on Tuesday, September 18, 1984 5:OOpm, the <br />- 9 - <br />
