Commissioner Lindsey indicated he <br />would support a one year limit. <br />The public hearing was opened. <br />No one addressed this matter. <br />The public hearing was closed. <br />A motion was made by Commissioner Innes, seconded by Commissioner <br />Lindsey that the ordinance presented by staff be recommended for <br />`adoption and that a one year time limit be added. <br />ROLL CALL VOTE <br />AYES: Commissioners Getty, Innes, Lindsey, <br />Wilson and Chairman Doherty <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />ABSENT: None <br />Resolution No. 2519 was entered and adopted recommending approval <br />of case RZ-84-10 as motioned. <br />PUD-79-11-4M, Cork Harbour Company <br />Application of Cork Harbour Company for a major modification to <br />case PUD-79-11, a single-family residential planned unit <br />development on the approximately 32 acre site located east of the <br />Pleasanton School upper playfield between Bernal Avenue and the <br />residences on the south side of Angela Street, to reduce by <br />approximately 40% the common open space required by the PUD <br />development plan for the project. The property is zoned PUD <br />(Planned Unit Development)-Medium Density Residential District. <br />Mr. Harris reviewed the staff report and stated that basically <br />there are two parts to this request for modification; one dealing <br />with the construction of a second story within a unit (with no <br />exterior enlargement to the residence); and the other dealing <br />with reduction of privately owned, but required open space <br />(approximately 40% of the amount required in the approved <br />development plan). The owner of Lot 67 applied for a building <br />permit to install a swimming pool and it was then that to City <br />found out at that fences were constructed in the required open <br />area. The City brought this to Cork Harbour's attention and they <br />applied for a modification to the PUD. Concerning the open <br />space, Mr. Harris stated that this area cannot be seen from <br />either Mirador or Angela Street. <br />Commissioner Lindsey had concern with a blatant disregard for the <br />development as approved. He asked why the developer didn't seek <br />approval for a modification through the City. He felt the <br />developer has to be held responsible for this.
