MINUTES <br />PLANNING COMMISSION <br />Page 13 <br />Commissioner Lindsey asked Mr. Valley if he was willing to pay two-thirds <br />of the fees. He indicated that this was his desire. <br />Mr. Jack Hovingh,4250 Muirwood Drive appreciated Chairman Jamieson's comments. <br />Traffic studies are totally irrelevant because of Condition No. 2 proposed <br />for the development. <br />The public hearing was closed. <br />Commissioner Lindsey asked Mr. Warnick if he has had time to review the three <br />traffic studies. Mr. Warnick said he had and that Mr. Pang's report comes <br />out just about in the middle where it should be. Anybody can criticize reports. <br />Commissioner Doherty felt a park could be used by everyone. He had no problem <br />with allowing the developer relief from a portion of the park dedication <br />fees. He is giving up a lot of land. His only concern with the development <br />had to do with desiring to have Bernal Avenue extended to Valley Avenue prior <br />to it being developed. He urged everyone to contract legislators so that <br />the PUC and railroad could be moved along in their process. Mr. Warnick <br />stated they have correspondence with the president of the railroad and they <br />are adamantly opposed to the application. The City has hired a special attorney <br />to prepare the City's application and to represent the City. Mr. Warnick <br />felt it is a technical issue and not one of politics. Commissioner Doherty <br />asked when the City would go before the PUC. <br />Mr. Swift stated that the City Attorney would be meeting with the Railroad <br />on Friday. So far the only thing received has been a negative reaction from <br />the railroad and the PUC. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner Getty <br />that the mitigated negative declaration prepared for case PUD-83-16 be adopted <br />inasmuch as conditions imposed on project approval would reduce any potentially <br />significant adverse effect to an insignificant level. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson <br />and Chairman Jamieson <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. 2439 was entered and adopted recommending approval of the <br />mitigated negative declaration as motioned. <br />A motion was made by Commissionerpoherty, seconded by CommissionerLindsey <br />that case PUD-83-16 be recommended for approval subject to the conditions <br />shown in the staff report and recommending that the developer be required <br />to pay only 2/3 of the park dedication fees for this project. <br />ROLL CALL VOTE <br />AYES: Commissioners Doherty, Getty, Lindsey, Wilson <br />and Chairman Jamieson <br />NOES: None <br />_.,..------------___ _ __.. ._ _ __ - ____ ., -----._.._..rY_ __-_ - _ _ __._._ _ _ .._ ._ .. .. _ _ __-T._ <br />
