He further asked
that the special events during the ear include Valentine's Day
and Halloween. When members come from other churches to attend
activities in Pleasanton they ridepool. Mr. Corley also pointed
out that there is a problem in landscaping as the driveway access
to the parking lot uses 2' of the Church's property. He didn't
believe the City wanted them to tear up the driveway and
landscape it. The Church, however, is not objecting to the
encroachment but does want to give notice of this fact to the
City. They feel they can work out the landscaping issue with the
City staff. Mr. Corley then reviewed the history of the building
with its uses.
Commissioner Lindsey asked Mr. Corley if the
rented the building for a church since 1907.
that a member of the Odd Fellows said he has
structure had been used as a church. Mr. Corley responded
that it was in 1979. Commissioner Michelotti then asked if there
were current plans to renovate the front of the building. Mr.
Corley stated that the liquor store lease expired three months
ago. Cellars Liquors was paying $200 per month rent and the
church felt this was not a reasonable amount of rent, the lease
was then not renegotiated and the liquor store must move out.
Staff has indicated in the staff report that the liquor store
will be out by 10/31/85 but in fact, his client has no certainty
that this will in fact take place. Legal action may be
necessary. The Church has much of their work done by voluntary
labor. They would be pleased to work with staff to participate
in renovating the outside of the structure to its original
condition. Commissioner Michelotti asked if the design would
have to be brought back before the Design Review Board and if the
plans would have to conform to the Downtown Design Guidelines.
Mr. Corley indicated that a condition of approval discusses this
matter. She further asked if they would be willing to
participate in some type of landscaping plan. Mr. Corley
indicated they would as funds are available. Commissioner
Michelotti then discussed the Church's schedule of events and the
time limit of 10:30pm. Mr. Corley indicated that the Church's
schedule is compatible with the neighboring uses.
Commissioner Wellman asked Mr. Corley about the lottery. Mr.
Corley indicated that the Deja Vu Publishing Company of the
Church of Divine Man sells lottery tickets to members. They do
not display an "L" and sell lottery tickets to outside people.
The public hearing was closed.
Commissioner Wellman asked if staff had received any complaints
about this use. Mr. Gee responded that the staff has not
received any complaints about the proposed use and it has been
advertised.
__ _ . __. _ r.__ _ ____._ _._
