potential flooding, runoff, etc., they will do as indicated in <br />the Geological Report done by Alpha. Water from the property <br />will go underground. No water will go over the Upshaw property. <br />It will go through Dr. Purrs property to the street. <br />The public hearing was closed. <br />Chairman Wilson asked for Staff to clarify Conditions No. 19 and <br />20. Mr. Okamura explained the existing rights-of-way and the <br />request for 30' reservation of land. He stated that No. 19 <br />refers to dedication of land and No. 20 is for reservation of <br />land, not deeded land. Mr. Swift, explained that if improvements <br />require additional property the reservation would be used. <br />Chairman Wilson expressed concern with dedication vs reservation. <br />Mr. Swift explained that it has been the past policy of the staff <br />to recommend dedications and the City Council now has a policy to <br />reserve property rather rather than require dedication property. <br />The Commissioners then discussed public work improvements in the <br />area. Mr. Swift clarified that much of the improvements <br />discussed are interim. Commissioner Wellman asked if the right <br />and left turn lanes referred to in Condition No. 19 are <br />temporary. Mr. Harris stated that they are temporary. <br />Chairman Wilson asked if this development is approved what <br />improvements will be made on Foothill Road at the time of <br />development. Mr. Harris stated that it would be just like <br />Foothill Knolls. Commissioner Innes asked about emergency access <br />and whether or not Fire Department had reviewed the plans. Mr. <br />Quaglia indicated that the Fire Marshal had no problem with the <br />design as proposed. <br />Chairman Wilson asked if the Commission agreed with staff, if <br />staff would agree to change the west lot line of Lot 2 to the <br />east. Mr. Harris explained it is desirable to get the toe of the <br />slope away from the property line 10-20' at least. <br />The public hearing was closed. <br />Commissioner Innes indicated he had walked the property. He <br />stated that if you keep the property on the low side of the fill, <br />then the responsibility of the slope is remaining with the <br />responsibility of the person who creating it. If it is moved, <br />Lot 2 will take on quite a responsibility with regard to the <br />slope. Lot 2 on the southeast side is very steep. He supported <br />staff in reducing Lot 1 and 2 to include all of the fill area and <br />a reasonable amount below it. <br />Chairman Wilson asked about the fault location. Mr. Harris <br />stated that it has never been found. Commissioner Lindsey <br />supported the staff report. Commissioner Hoyt agreed with <br />Commissioner Lindsey. Commissioner Wellman disagreed. She felt <br />the lot was buildable as long as it was properly engineered. <br />Commissioner Lindsey asked what the comments of the other <br />Commissioners are regarding Condition No. 19 and #20. <br />- 5 - <br />_~ <br />
