Minutes <br />Planning Commissio. <br />January 9, 1985 <br />PUD-79-11-4M, Cork Harbour <br />Application of Cork Harbour Company for a major modification to <br />case PUD-79-11, a single-family residential planned unit <br />development on the approximately 32 acre site located east of the <br />Pleasanton School upper playfield between Bernal Avenue and the <br />residences on the south side of Angela Street, to reduce by <br />approximately 40% the common open space required by the PUD <br />development plan for the project. The property is zoned PUD <br />(Planned Unit Development)-Medium Density Residential District. <br />Mr. Harris presented the staff report indicating that it is <br />staff's understanding that Cork Harbour will be presenting 12 <br />signatures in a letter of agreement and in support of a revised <br />fencing plan which the applicant also intends to present. He <br />explained that the blanks on the staff report were left on <br />purpose and perhaps the date of 1/9/85 could be inserted. Staff <br />is recommended that the fencing all be installed at one time and <br />ask hat the Planning Commission set a period of time for the <br />completion of the fencing. <br />The public hearing was opened. <br />Dave Powers, 629 Abbie Street, stated that Jeff Lawrence of Cork <br />Harbour has resigned and Mr. Powers will be presenting the letter <br />and fencing plan. He stated it is very difficult to get all <br />people to agree to 15 separate conditions. He stated that if the <br />map he presented is approved, Cork Harbour has indicated <br />willingness to draw it up in a professional manner. Chairman <br />Wilson asked if there were any changes to the document signed by <br />the homeowners. Mr. Powers stated there are two changes; one <br />relating to stepping stones as a couple of homeowners didn't want <br />stepping stones across their landscaping; the other one relates <br />to good neighbor fencing and they don't have all "good <br />neighbors". There is a problem with the cost. He believed this <br />could be worked out. Everyone has signed the plan and the <br />letter. Chairman Wilson then asked Mr. Powers to present the <br />letter to the City Attorney for review. <br />Messrs. Swift, Harris, Warnick, Okamura and Powers reviewed the <br />signed letter and signed plan presented. <br />Commissioner Lindsey asked Mr. Powers if an estimate has been <br />presented to the homeowners as to the cost of the fences. Mr. <br />Powers indicated that specific estimates have not been made but <br />it will cost approximately $10 per foot. <br />Commissioner Lindsey then asked about Mr. Lawrence's signature on <br />the letter if he has in fact resigned from Cork Harbour. Mr. <br />Swift indicated that he would assume if Mr. Lawrence had the <br />authority to sign the letter in the first place, the signature <br />would still be valid. <br />Commissioner Innes inquired about a fence contract being let and <br />who would negotiate it.
