EXHIBIT teA" <br />CONDITIONS OF APPROVAL <br />Z-90-326 <br /> <br />The regrading of Lot 3 of Tract 5849 shall conform <br />substantially to the revised grading plan, dated "Received May <br />24, 1990", on file with the Planning Department. <br /> <br />The retaining wall installed as part of the regrading of the <br />subject wall shall meet the requirements of the improvement <br />plans for Tract 5835, on file with the Public <br />Works/Engineering Department. <br /> <br />The applicant shall submit to the Planning Department a plan <br />illustrating any proposed above ground structure (i.e. <br />trellis, deck, gazebo, shed, etc.) and its location, prior to <br />construction. The Planning Department shall notify adjacent <br />property owners of the proposed structure prior to any action <br />on the submittal. In the event an adjacent property owner <br />asks for a formal hearing concerning the requested structure, <br />a hearing shall be scheduled at the next available City <br />Council meeting for City Council review and approval. In the <br />event no hearing is requested within 7 days following sending <br />of notice, the Zoning Administrator may approve, approve <br />conditionally, or deny the requested application, following <br />the guidelines established in Section 18.20 of the Municipal <br />Code for Design Review approval of new applications. <br /> <br />The applicant shall install the landscaping shown on the <br />attached Exhibit "B" contemporaneously with the construction <br />of the retaining wall and maintain it in perpetuity. In the <br />event that any of the plant material dies, the applicant shall <br />remove and shall replant with identical plant material within <br />30 days of the death of the plant material. <br /> <br />The applicant shall properly maintain the concrete "V" ditch <br />adjacent to the rear property line at all times, making it <br />continuously available to pass storm drainage at the full <br />capacity to which it was designed. <br /> <br />No regrading shall commence until the proposed landscape <br />planting plan for the adjacent lots in the Vintage Hills <br />subdivision is approved by the city. <br /> <br />SR:90:325 <br /> <br /> <br />
