Minutes <br />Planning Commission <br />May 13, 1987 <br />recommended that the Commission include this as a condition <br />should they elect to approve this application. <br />Commissioner Berger said she was sympathetic to both sides of the <br />issue, and could support a conditional use permit for one year <br />with semi-annual review if moved to the other side of the yard, <br />and noise mitigation measures were put in place, so that the <br />impact on the neighbors would be reduced. <br />Commissioner Michelotti agreed with the comments of Commissioner <br />Berger, however, she felt one year was too short. She preferred <br />approval to be granted for three years with semi-annual review. <br />Commissioner Tarver felt the situation to be difficult as both <br />parties have rights and need to be protected. He felt that <br />neighborhood backyards are better than streets for skateboarding. <br />Backyards would also offer supervision. He supported moving the <br />ramp, approving the use for three years with six month review <br />along with the noise attenuation methods discussed. <br />A motion was made by Commissioner Michelotti, seconded by <br />Commissioner Berger that Case UP-87-17 be approved subject to the <br />conditions of the staff report, amending Condition No. 1 to read <br />"That the ramp could be located closer than 20 feet to the rear <br />property line if sited to the rear of the chimney in the north <br />side of the yard," Condition No. 2 so that the ramp will be <br />covered with two layers for masonite for the purposes of noise <br />mitigation, and amending Condition No. 3 reflecting that approval <br />is granted for three (3) years with a semi-annual review. <br />ROLL CALL VOTE <br />AYES: Commissioners Berger, Hoyt, Michelotti, Tarver and <br />Chairman Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-87-50 was entered and adopted approving Case <br />UP-87-17 as motioned. <br />PUD-80-2-5D, Bernal Avenue Associates <br />Application of Bernal Avenue Associates for design review <br />approval to construct a four-building, approximately 115,000 sq. <br />ft. office complex, to be located on an approximately 9.2 acre <br />site, located generally in the area bounded by I-680, the Arroyo <br />Del Valle, and Roll Center Parkway.
