Minutes <br />Planning Commission <br />April 8, 1987 <br />Mr. Mogenson then presented the color board and reviewed the <br />colors and materials to be used in the project. <br />Mr. Ferreri then reviewed the site layout depicting the <br />elevations of the garages relative to the rest of the project. <br />Commissioner Tarver asked the applicant if they have any <br />objections to adding the amenities recommended by staff in the <br />recreation area. Mr. Ferreri said they agree totally. <br />Commissioner Michelotti addressed the traffic report, she stated <br />even backing out the projects which have been approved but <br />unbuilt, traffic levels on Dublin Road/Foot Hill Road are at <br />unacceptable levels. Mr. Ferreri said they would only be adding <br />.O1% to that particular intersection. Mr. Ferreri said the <br />Hopyard Road construction will end within a year making the <br />traffic situation better at this intersection. Mr. Ferreri asked <br />that Condition No. 18 be deleted from the staff recommendation. <br />Chairman Lindsey said he was impressed with the project as it is <br />to be sold at an attractive sales price and would feel <br />comfortable in considering the elimination of Condition No. 18. <br />However, he would like to see some restriction whereby first time <br />buyers would not be investors, but rather have the units owner <br />occupied if possible. Mr. Ferreri said this would be an <br />excellent concept and off hand could not see why this wouldn't <br />work. If legal, he wouldn't have a problem in adding this <br />condition as long as the developer had the right to rent the <br />unsold units. Chairman Lindsey said he would like to see the <br />first-time buyers sign an agreement that they would occupy the <br />units. Mr. Ferreri said this could be worked out as long as they <br />are allowed to rent out the units. Mr. Swift asked for <br />clarification and asked if the agreement would apply to the first <br />purchaser only. Chairman Lindsey said yes, not necessarily a <br />first-time homeowner, but the first time purchaser of the units <br />themselves. Chairman Lindsey said he would be inclined to give <br />in on some of the other issues since the developer would go along <br />with this condition. Mr. Ferreri reconfirmed he has no objection <br />to such a condition as long as there are no legal problems with <br />it. <br />Commissioner Berger discussed Page 5 of the staff report and the <br />fact that some of the backs of the units would come to within 10' <br />of the property line. Mr. Mogenson then addressed the Commission <br />stating there is some misunderstanding between City staff and <br />their office because of the average is 20 feet and not 10 feet. <br />Commissioner Michelotti asked if this project gets approval <br />without the restriction of the Stoneridge interchange condition, <br />when would the developer foresee obtaining Growth Management <br />approval. Mr. Ferreri said he would hope to commence <br />negotiations with the City as soon as possible. It is their <br />intention to try to commence construction before the end of the <br />year - that is their goal. The financial market is critical to <br />this project.
