He went into length regarding the similarities of the plan proposed at the June 22 meeting. He felt that the "blue" plan proposed tonight was better than the approved plan. He felt the driveway problems were resolved in the proposed plan, but not in the approved plan. He stated that he has worked with Mr. Swift on the "blue" plan proposed tonight but not on the approved plan. He stated that the proposed plan had received 2/i approval by the Homeowner`s Assn. which is in accordance with the CC3cRs. He said he would agree to reducing the grading and would be willing to continue working with staff. He stated that he had a meeting of 3-4 hours with the Assn. He felt that the retaining wall proposed by the Assn. would be unsightly for Mr. Balch. He estimated that the difference between the proposed plan tonight and the approved plan was about 444 yards of dirt. He requested approval of the "blue" plan proposed tonight. Chairman Hoyt asked Mr. Swift to comment on the new proposed plan. Mr. Swift explained that the proposed plan would require nose grading, but that the grading is not that visible. Chairman Hoyt asked Mr. Swift if in comparing the plans, whether the proposed plan is any more damaging than the other. Mr. 5wif t said the proposed plan was slightly superior. Commissioner Tarver asked Mr. Swift if he had been involved in the meeting with the Blacks and the Assn. Mr. Swift said he was able to attend for the first hour. Commissioner Tarver asked Mr. Black if the people opposing the plan were present at the meeting. Mr. Black said they have not seen the proposed plan. Commissioner Hovingh asked Mr. Black to paint out where the dirt was to be removed. Mr. Black pointed this out on the overlay. He said if this plan were approved, they would attempt to mitigate the area in question. Commissioner Mahern asked if the proposed plan tonight would put the top of the house at 622'. Mr. Black said it would probably be 626 ' . Commissioner Mahern asked what the height of the Heritage tree is. Mr. Black said it is 63G" with the trunk being at 584'. He added they will save that tree at all costs. Mr. Black discussed the driveway configuration with Commissioner Mahern. Jim Balch, 14 Grey Eagle Ct. stated he is a member of the Grey Eagle Ct.
