Mr. Swift presented the staff report recommending approval of
Case F'UD-83-12-5M subject to conditions of the staff report.
The public hearing was opened.
Steve Sterns, X137 Stevens Creek blvd., Cupertino, represented
the application. He concurred with the conditions of the staff
report, stating that he had slides available if the Commission
wished to see them. However, the subject has been thoroughly
covered in a previous public hearing.
The Commission did not think it was necessary to view the
slides.
Herb Singleton, :?~CT7 Martin Avenue, felt that a 25` setback was
a compromise for the residents. He felt taking that away would
be reneging on those people. He thought the staff report was
somewhat misleading as there are some single-family homes in the
area. He summarized that to allow a ?' setback is ridiculous.
Ted Hrokaw, Lot 7 on the corner of Martin and Nichole, expressed
a desire to have a final decision so that he could go ahead with
his landscaping.
Howard Thacken, 199 Martin Ave., expressed opposition to a ~5`
setback. He wondered wh^ would pay for the sprinkler for that
kind of setback. He spoke about the fencing in the area.
The public hearing was closed.
Commissioner Berger felt that this Gase had been investigated
thoroughly in previous hearings.
A motion was made by Commissioner Berger, seconded by
Commissioner Tarver recommending approval of Case PUD-8~-1~-5M
subject to the conditions of the staff report.
ROLL CALL_VOTE:
A~{ES: Commissioners Berger, i"lahern, Tarver, and Chairman
Micheletti
h1DES: Commissioner Hovingh
AFlSENT: Commissioner Hoyt
ABSTAIN: None
F:esolution No. F'C-88-1Ui was entered and adapted approving Case
F'UD-83-1.^c--SM as motioned .
Chairman Micheletti noted that this is a situation with
individual case by case review by the Planning Department and
felt that each could be appropriately worked out.
F`age 12
