UP_88=541_Stanley_Partners <br />Application of Stanley Partners for a conditional use permit to <br />operate a supermarket on the site of a proposed shopping center <br />located on the north side of Stanley Boulevard between First <br />Street and Valley Avenue. Zoning for the property is PUD <br />tPlanned Unit Development) - Commercial and Office District. <br />Mr. Swift presented the staff report recommending denial of Case <br />UF`-88-54. <br />The public hearing was opened. <br />Tom Byrnes represented the application. He said he was there <br />to answer any questions. <br />Commissioner Hovingh said he still had difficulty with this <br />case. He asked Mr. Etyrnes if any l~;ind of deal was settled with <br />Mr. Richard Irby regarding acquisition of some of his property <br />for the possible widening of Stanley Filvd. Mr. 5yrnes said that <br />nothing has been finalised, but Mr. Irby has agreed to give cam' <br />of his property if treated equaliy with everyone else. This <br />information has been given to staff. <br />Stanley Rathbone, ,:~~5 Ray Street, said a railroad used to be <br />operated in the proposed area and was used in World War II. He <br />wondered if any provision would be made if it were needed again <br />for a similiar purpose. Mr. Swift said the land aaould have to <br />be condemned in a case such as war_ <br />The public hearing was closed. <br />Commissioner Mahern stated that even though she liked the <br />original application she did not feel it was feasible to put in <br />another supermarket. <br />Chairman Micheletti said she was still concerned with the <br />parking siti.aation and could net support the application. <br />Commissioner Tarz:er said he could not support the application. <br />A motion was made by Commissioner Mahern, seconded by <br />Commissioner Tarver denying Case UF'-85-54 as required findings <br />cannot be made to grant appro*.~al of this case. <br />ROLL_CALL_VOTE <br />A4'ES: Commissioners Hovingh, Mahern, Tarver, and <br />Chairman Micheletti <br />NOES: None <br />AE~SENT: Commissioner L~erger and Hoyt <br />AEeSTA 1 N: None <br />Resolution No. FC-EiS-1~~ was entered and adopted denying Case <br />UF'-88- 4 as mot 3 oned . <br />Rage .=~ <br />
