The public hearing was opened. Harvey Levine, 7~J20 6'--.all Center F'arF;way, Suite lA~~, represented the application, stating he has reviewed the staff conditions and has no problem with them. He noted that the City Council has approved the ATM as there was the proper number of banns downtoain. The public hearing was closed. A motion was made by Commissioner Berger, seconded b}~ Commissioner Mahern that the required findings have been made, and approving Case UF'-87-bCi subject to the canditions of the staff report. UP_-87-~81_Abbanat Application of Carol Abbanat for a modification to a conditional use permit allowing f or the instruction of piano lessons in an existing residence to delete the requirement pertaining to limitation of hours of operation located at 4b45 Gatetree Circle. Zoning for the property is R-i-b5D0 (Single-family Residential) District. Mr. Swift presented the staff report, recommending that Case OF-87-38 be approved subject to conditions of the staff report. He presented a letter to the Commissioners from a neighbor who opposed the application in its entirety. The public hearing was opened. Carol Abbanat, 4b45 Catetree Circle, represented the application. She stated that she has met all the conditions set forth by staff since her last appearance here. She said she no longer has employees who don't live in the home, adding that her facilities and students have been observed by the City's staff. She felt she could live with the staff canditions but was concerned about additional restrictions in that it could ultimatley impact the other 5U some music teachers in the City. Commissioner Mahern as~r~-ed Ms. Abbanat if she has make-up lessons on Saturday. Ms. Abbanat said that she does during the day. Page 4
