SECOND AMENDMF,NT'I'O AGREF,MENT PROVIDING FOR STABIL[LATION OF <br />ivIOBILF.HOi~IE SPACE RENTS <br />THIS SECOND AMENDMENT 'f0 THE AGREEMEN"C PROV[D[NG FOR 1'HE <br />S"fABIL[LA"PION OF MOBILEHOME PARK REN"I'S is made March 20, 2007 between <br />F;dtnund and Barbara Gil, Daniel Guggenheim, and Philip Hoon (collectively, Park Owners) and <br />the City of Pleasanton (City). <br />Recitals <br />A. On December 28, 2001 the Park Owners and the City entered into an Agreement <br />Providing for Stabilization of Mobilehome Rents (the Agreement) which Agreement establishes <br />the rents that may be charged for spaces at the Fairview Trailer Park, Vineyard Mobile Villa, and <br />the Hacienda Mobilehome Park. <br />B. The Agreement as amended has a termination date of March 31, 2007. <br />C. Representatives ofthe Park Owners and of the City, along with residents of the <br />Parks, continue to discuss terms and conditions for a revised Agreement but those discussions <br />have not yet resulted in such revised Agreement. <br />D. Without this proposed amendment to the Agreement, proposing to extend the term <br />of the Agreement to July 31, 2007, the Agreement will expire and the C'ity's Mobilehome <br />Stabilization Ordinance would apply to rents in the three Parks, the application of which could <br />result in the rents being raised to existing residents. <br />E. By approving this Second Amendment, no rent of any current resident within the <br />Parks will be affected. <br />NOW, Tf [F?REFORE, inconsideration of the faithful performance of the terms, conditions, <br />covenants and promises set forth in the Agreement, as amended previously and as amended <br />herein, the parties agree as follows: <br />Section 1. Article X[ of the Agreement is amended to read as follows: <br />"YI. TERM <br />The Agreement shall begin on January 1, 2002 and shall terminate on July 3l, 2007." <br />Section 2. [n all other respects the terms and conditions of the Agreement as amended <br />December 19, 2006, are to continue in full force and effect. <br />
