SECOND AMENDMF,NT'I'O AGREF,MENT PROVIDING FOR STABIL[LATION OF ivIOBILF.HOi~IE SPACE RENTS THIS SECOND AMENDMENT 'f0 THE AGREEMEN"C PROV[D[NG FOR 1'HE S"fABIL[LA"PION OF MOBILEHOME PARK REN"I'S is made March 20, 2007 between F;dtnund and Barbara Gil, Daniel Guggenheim, and Philip Hoon (collectively, Park Owners) and the City of Pleasanton (City). Recitals A. On December 28, 2001 the Park Owners and the City entered into an Agreement Providing for Stabilization of Mobilehome Rents (the Agreement) which Agreement establishes the rents that may be charged for spaces at the Fairview Trailer Park, Vineyard Mobile Villa, and the Hacienda Mobilehome Park. B. The Agreement as amended has a termination date of March 31, 2007. C. Representatives ofthe Park Owners and of the City, along with residents of the Parks, continue to discuss terms and conditions for a revised Agreement but those discussions have not yet resulted in such revised Agreement. D. Without this proposed amendment to the Agreement, proposing to extend the term of the Agreement to July 31, 2007, the Agreement will expire and the C'ity's Mobilehome Stabilization Ordinance would apply to rents in the three Parks, the application of which could result in the rents being raised to existing residents. E. By approving this Second Amendment, no rent of any current resident within the Parks will be affected. NOW, Tf [F?REFORE, inconsideration of the faithful performance of the terms, conditions, covenants and promises set forth in the Agreement, as amended previously and as amended herein, the parties agree as follows: Section 1. Article X[ of the Agreement is amended to read as follows: "YI. TERM The Agreement shall begin on January 1, 2002 and shall terminate on July 3l, 2007." Section 2. [n all other respects the terms and conditions of the Agreement as amended December 19, 2006, are to continue in full force and effect.
