® ®TechLaw <br />Mr. David Darlington <br />July 14, 2006 <br />Page 2 <br />In addition, TechLaw has reviewed and prepared summaries of several documents for the CMC in <br />periodic progress reports including: <br />• First Semiannual 2005 Groundwater Monitoring Report <br />• 2004-2005 Amral Report for Storm Water Discharge <br />• Combined Title V Semiannual and Partial 834 Annual Report <br />• Storm Water Pollution Prevention Program <br />• Conditional Use Pemrit <br />• Second Semiannual and Amoral 2005 Groundwater Monitoring Report <br />• Proposed Title 27 Detection Monitoring Program for the Existing Fill Area 1 and Proposed <br />F;xpansion Area for ALRRF, Jinre 1998 <br />In the review of these documents, TechLaw has not found any evidence to suggest that ALRRF <br />operations are not in compliance with applicable laws and regulations. <br />LANDFILL INSPECTIONS <br />In general, ALRRF appears to be operating in compliance with applicable laws and regulations, including <br />thickness and type of daily and intermediate cover, dust controls, litter controls, and vector controls, <br />separation of hazardous materials to the extent possible, maintenance of working areas, control of surface <br />water pondmg and erosion, separation of Class II materials and asbestos into appropriate areas, leachate <br />and landt711 gas collection and treatment. <br />The following types of concerns were noted during landfill inspections: <br />• occasional substantial litter offthe landfill, depending on wind conditions (always collected <br />by WMAC staff) <br />• vectors (birds) noted frequently <br />• occasionally inadequate thickness of cover (noted by the LEA and repaired promptly) <br />• fencing in asbestos area in need of repair <br />• erosion in some areas during the wet season (including 3 large washouts in closed portion of <br />landfill) <br />• some ponding during the wet season <br />It should be noted that, while'CechLaw conducted inspection approximately once per month, the LEA <br />conducts inspections weekly. Many times an area of concern (such as leachate seeps or inadequate <br />cover) was noted by the LEA, brought to the attention of WMAC and corrected between TechLaw <br />inspection dates.
