The purpose of this letter is to provide information to the Community <br />Monitor Committee (CMC) to assist in decisions regarding the future direction and interests of the CMC. <br />According to the Settlement Agreement, WMAC is to "fund a Community Monitor ... to monitor the <br />ALRRF's compliance with environmental laws and regulations.. and to advise the public and the Cities <br />of Livermore and Pleasanton about environmental and technical issues relating to the operation of the <br />ALRRF." There is no provision in the Settlement Agreement for sunsetting the Community Monitor <br />Committee or the Commmtity Monitor. <br />Techlaw has fulfilled the role of Community Monitor, retained and supervised by the CMC, since March <br />of 2005. During this time Techlaw has: <br />• reviewed all reports, documents and data which WMAC. is required to submit to any <br />regulatory agency <br />• reviewed all other reports, documents, and data regarding ALRRFs compliance with <br />applicable laws and regulations <br />• prepared oral presentations to the CMC on technical and environmental issues <br />• prepared written progress reports to the CMC <br />• maintained a website repository of information accessible to the CMC and, recently in part, <br />to the public <br />• conducted 15 landfill inspections of which 7 were in the company of the LEA <br />DOCUMENTS REVIEWED <br />Techlaw has reviewed many documents for compliance with applicable laws and regulations including: <br />• Monthly Tonnage Reports <br />• Second Semi Annual and Annual 2004 Groundwater Monitoring Report <br />• Technical Memorandum and Pilot Study for Termination of the Groundwater interceptor <br />Barrier <br />• Joint Technical Document <br />• Gruundwater Interceptor Barrier Pilot Study Report <br />AL1"OIC -Community Monitor Gvaluation.wpd <br />ATLANTA [iOSTUN CHUALO • DALLAS • DEMlER • NEW YORK OVERLAND PARK • PHII ADEI PH IA • SACRAMENTO • SAN hRANCISIU • SI AI ILI. • VJASIIiN GTON, DC S® <br />
