BACKGROUND <br />Golden Eagle Farm's approved development plan and design guidelines outline the site <br />development standards for the custom lots located west of Foothill Road. The minimum <br />rear yard setback is twenty percent (20%) of lot depth, or thirty feet (30'), whichever is <br />greater. Setbacks for the primary residence and accessory structures are the same. <br />DISCUSSION <br />The proposed modification consists of decreasing the rear yard setback from 30 feet to <br />20 to accommodate a 450-square-foot pool cabana approved by the Zoning <br />Administrator on September 2, 2004 (PADR-1073). On April 19, 2005, the applicant <br />received approval for a minor modification to the Golden Eagle Farm PUD development <br />standards to reduce the rear yard setback from the required 48 feet to 30 feet. The <br />current modification is to further reduce the rear yard setback from 30 feet to 20 feet. <br />The purpose of the Golden Eagle Farm Development Plan is to ensure development <br />that is compatible with the size of the property, its natural terrain and vegetation, and <br />the neighboring community. The subject property consists of flat terrain and backs up to <br />designated open space. The distance to the nearest property from the rear of the <br />subject property is approximately 105 feet. A reduction in the rear yard setback for <br />construction of an accessory structure will require neither grading nor removal of <br />existing trees. As part of project approval, staff is requiring the applicant to plant <br />vegetation between the cabana and the rear property line to provide additional <br />screening. Because the reduced rear yard setback of the subject property is next to the <br />development's open space, and the project is conditioned to provide additional <br />screening, the visual impact to residents of neighboring lots and the public will be <br />minimal. <br />PUBLIC NOTIFICATION/COMMENT <br />Staff sent notices of the proposed development plan modification to all property owners, <br />tenants and residents located within 1,000 feet of the subject property on March 2, <br />2007. As of the writing of this report, staff has received no public comment. Staff <br />received a letter of approval for the project from the Golden Eagle Estates Home <br />Owners Association. <br />ENVIRONMENTAL ASSESSMENT <br />This project is categorically exempt from environmental review pursuant to the <br />California Environmental Quality Act (CEQA) Section 15305(a) "Minor lot line <br />adjustments, side yard, and setback variances not resulting the creation of any new <br />parcel;" therefore no environmental document accompanies this report. <br />Page 2 of 3 <br />
