5. Pursuant to §51283(a), the amount of the cancellation <br />fee shall be 12 1/2 percent of the fair market value of the <br />property on the date City Council approves tentative <br />cancellation. Based upon information provided by the. <br />Alameda County Assessor, the City Council hereby determines <br />that the cancellation fee shall be $687,500. <br /> <br />6. Landowner's petition for cancellation was accompanied by <br />a proposal for a specified alternative use of the land which <br />listed those governmental agencies known by the landowner to <br />have permit authority related to the proposed alternative <br />use. <br /> <br />7. A public hearing has been held on the petition as <br />required by §51284. <br /> <br />8. The cancellation is consistent with Title 5, Part I, <br />Chapter 7 of the California Government Code. <br /> <br />9. The cancellation is for land on which a Notice of <br />Nonrenewal has been served pursuant to §51245. <br /> <br />10. Cancellation is not likely to result in the removal of <br />adjacent lands from agricultural use. <br /> <br />Uses on adjoining properties are limited to grazing and open <br />space use. These agricultural uses are compatible with the <br />proposed alternative land use - low density housing. <br />Indeed, the agricultural uses of the Garms property itself <br />have coexisted with similar residential uses on its eastern <br />border for over 15 years. The existing grazing activities <br />on adjoining sites may continue with negligible impact after <br />implementation of the proposed residential use. <br /> <br />11. Cancellation is for an alternative use which is <br />consistent with the applicable provisions of the City's <br />General Plan. <br /> <br />The general plan designation for the Garms property is low <br />density residential on the easterly portion of the parcel <br />and rural density/open space on the westerly portion of the <br />Garms parcel. The general plan calls for a density range of <br />0-2 units per acre in the low density residential <br />classification with an increase in density up to 2.5 units <br />maximum per acre for an appropriate planned unit <br />development.
