Existing (Old) Vineyard Avenue <br />In preparing the development plans for the subdivisions along Old Vineyard Avenue, it <br />was discovered that while additional right-of-way had been dedicated to Alameda County <br />in the 1970's for the future widening of the roadway (Vineyard Avenue), this street <br />widening was never completed. The street right-of-way was 50 feet before the additional <br />dedication was made to the County. The original 50 feet of right-of-way width is more <br />than adequate for the proposed Vineyard Trail; consequently, the additional 18-foot width <br />is not needed. The 18-foot street dedication was made in fee title to Alameda County, <br />which was then conveyed to the City pursuant to California Street and Highway Code <br />section 989. It appears that this small portion of property has negligible value and its <br />only logical use is for landscaping in the adjoining development. To allow this use of the <br />excess right-of-way, the City will need to quitclaim its interest in the excess right-of-way <br />to the adjoining property owner. <br />The California Streets and Highways Code provides for an abbreviated, summary <br />vacation procedure for public rights of way under certain conditions, including when <br />there is excess right of way or when a street has been superseded by relocation. In this <br />situation, not only has the excess portion of the right of way never been used as a <br />street, but also the use of a portion of the existing Vineyard Avenue as a vehicular street <br />has been superseded by the new alignment of Vineyard Avenue. In vacating this <br />excess width of the existing Vineyard Avenue adjacent to the Reznick property, no <br />property access will be cut off nor will any public service easement be terminated, as no <br />utilities are located in this excess portion of the right of way. <br />Staff is recommending that an Public Service Easement be reserved by the City along <br />the 18-foot dedication for public utility purposes. The easement could be used if the <br />PG&E 60 KVA overhead electric is required by the school construction to be moved to <br />the opposite side of Old Vineyard Avenue. A disclosure to the future residents of the <br />Tract 7815 regarding the potential 60 KVA line relocation has been required along with <br />the other Vineyard Specific Plan disclosures. <br />Staff recommends quitclaiming the City's interest in the 18 foot wide excess right-of-way <br />to Threehand LP. <br />Purchase and Sales Agreement <br />As approved by the Council at its meeting of September 19, 2006, as compensation for <br />the water reservoir parcel, the City has agreed to reimburse Mr. Reznick for final <br />improvements to the required private access road. The First Amendment to the <br />Purchase and Sales Agreement has been executed by the applicant. <br />Agreements <br />Applicant has provided to the City the following items: <br />• Reimbursement Agreement for the construction of the water reservoir access road <br />and related utilities; <br />• First Amendment to the Purchase and Sales Agreement; <br />Page 3 of 4 <br />
