between the rear deck and the southern property line, and all trees between the <br />other areas of the house and the southern property line shall be preserved, <br />unless the trees are required to be removed per condition of approval #14. Prior <br />to commencement of any site work, the project developer shall install tree <br />protection fence, at the dripline of the existing trees on the subject site to be <br />preserved. <br />29. Prior to any site work, the project developer shall post cash, letter of credit, or <br />other security satisfactory to the Planning Director in the amount of $5,000.00 for <br />each tree to be preserved should any work, utilities or otherwise, be conducted <br />within an area in which potential impacts may be anticipated. This cash bond or <br />security shall be retained for one year following acceptance of public <br />improvements or completion of construction, whichever is later, and shall be <br />forfeited if the trees are destroyed or substantially damaged. In the event any <br />trees are destroyed or substantially damaged, an arborists' assessment, at the <br />developer's expense, shall be required to determine the damage or loss, then for <br />each damaged or destroyed tree the applicant shall plant at least two native 24" <br />box non-deciduous trees in approximately the same location, and pay the <br />resultant value of the damaged or destroyed trees, as stated in the Hortscience <br />Report, Exhibit A, minus the cost of the replacement trees, to the City's Urban <br />Forestry Fund. <br />30. If the City Engineer determines additional grading must occur where a tree <br />required to be preserved is located, the applicant shall replace the tree with at <br />least two native 24" box non-deciduous trees in approximately the same location. <br />An arborists' assessment, at the developer's expense, shall be required to <br />determine the value of the tree to be removed and the resultant sum, minus the <br />cost of the replacement trees, shall be paid to the City's Urban Forestry Fund. <br />The location and species of the replacement tree shall be subject to the review <br />and approval of the Planning Director. <br />Open Space Area <br />31. The open space area required by the Vineyard Avenue Corridor Specific Plan <br />shall be entirely located on Lot 3, shall be a minimum of 1,575 square feet in <br />size, and shall generally be located by the western property line. The final <br />location shall be subject to the review and approval of the Planning Director. <br />32. The ownership, maintenance, and use of the open space area shall adhere to the <br />requirements of the Open Space Ownership and Maintenance Plan approved as <br />part of this PUD development plan. <br />33. With the recording of the parcel map, the applicant shall record a conservation <br />open space easement over the required open space area on Lot 3. The wording <br />of the easement shall be subject to the review and approval of the City Attorney. <br />34. All future landscaping in the open space area shall be native species. <br />9 <br />
