RESOLUTION NO. 07- 087 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />DENYING THE APPEAL OF CASE PAP-102, THEREBY UPHOLDING THE <br />PLANNING COMMISSION'S APPROVAL OF THE APPLICATION OF JOHN MILLER <br />ARCHITECTS/SAINT ELIZABETH SETON CHURCH FOR DESIGN REVIEW <br />APPROVAL AND VARIANCE FROM THE PLEASANTON MUNICIPAL CODE, AS <br />FILED UNDER CASE PDR-561/PV-158 <br />WHEREAS, John Miller Architects/Saint Elizabeth Seton Church has applied for design <br />review approval (PADR-561) to modify the Saint Elizabeth Seton Church Master Plan to <br />construct an approximately 22,296-square-foot parish center building with gymnasium and <br />related site improvements on the existing church site located at 4001 Stoneridge Drive, and for <br />a variance from the Pleasanton Municipal Code (PV-158) to allow the proposed parish center <br />building with gymnasium to be approximately 34 feet tall, where 30 feet is the maximum height <br />limit; and <br />WHEREAS, zoning for the property is A (Agriculture) District; and <br />WHEREAS, at its meeting of November 29, 2006, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City staff <br />concerning this application, approved the application for design review and variance; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the Pleasanton <br />Village Association and Rohit and Sonia Gupta submitted an appeal (PAP-102) to the decision <br />of the Planning Commission; and <br />WHEREAS, at its meeting of January i6, 2007, the City Council received a report from <br />the Director of Planning and Community Development, together with a copy of the staff report to <br />the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on January 16, 2007, at which time <br />the appellants, applicants, and any other member of the public were offered an opportunity to <br />present evidence regarding this appeal; and <br />WHEREAS, after a review of the materials presented, the City Council determined that <br />the proposed master plan modification and parish center building design are appropriate for the <br />site and will not detrimentally affect the surrounding properties, and are consistent with the <br />General Plan and the zoning regulations of the zoning district of the property; and <br />WHEREAS, the City Council made the following findings for the variance: <br />1. Because of special circumstances applicable to the property, including size, <br />shape, topography, location or surroundings, the strict application of the provisions of <br />this chapter deprives such property of privileges enjoyed by other properties in the <br />vicinity and under identical zoning classification. <br />Part of the reason the building needs to exceed the 30-foot height limit is to accommodate the <br />minimum interior height of the basketball court and the necessary structural, ventilation, and <br />drainage requirements of the building.
