MODIFICATIONS TO THE SPECIFIC PLAN Over time the Specific Plan tray be changed. In the event the modifications produce changes to the Financing Program, they shall be incorporated into the Financing Program. Examples include: additions or deletions to planned shared infrastructure improvements, changes to the planned land toes, or adjustments to the areas included in the Specific Plan. Modifications necessitating changes to the Financing Program shall follow the basic principles outlined herein for accommodating changes to infrastructure improvement cost assumptions. Financing Program f~21. Adjustments to the Financing Program caused by Specific Plan modifications shall be prospective only. No developed property shall be required to either pay more or be granted a refund as a result of Specific Plan modifications. Financing Program #22. Adjustments shall be made following Specific Plan modification and shall take effect immediately upon the effective date of the modification. ALTERNATIVE FINANCING PROGRAMS This Financing Program is not intended to be the sole vehicle for payment/collection of the Specific Plan fees nor construction of shared infrastructure improvements. Any developer may propose an altemative mechanism for payment of its total shared cost and/or construction of shared infrastructure improvements. Examples include: multi- party agreements for construction of infrastructure or local assessment districts. Any substitute mechanism, however, must conform to this Financing Program and the Specific Plan in allocating cost shares, reimbursing prior developers, and other Program specifics. Financing Program #23. The City Council may approve alternative financing mechanisms for any ofthe shazed infrastructure improvements as long as said mechanisms are consistent with the principles outlined in this Financing Program.
