BACKGROUND <br />The Lemoine Ranch's developers were required to construct improvements across their <br />Foothill Road frontage. Around that same time, City Traffic Engineering staff was <br />working with the Foothill High School staff to improve circulation and safety along <br />Foothill Road while entering and exiting the school. One of these safety improvements <br />was to extend the median island beyond the Lemoine Ranch's frontage south to the <br />most northerly driveway of Foothill High School. This new median island provides a <br />longer left turn lane into the high school parking lot. To facilitate these improvements <br />along the Foothill High School frontage, a condition of approval was added to the <br />Lemoine Ranch project, requiring the developer to extend the median. <br />Reimbursement Agreement <br />When the City Council approved PUD 99-01 (Lemoine Ranch Estates Development), <br />there was no discussion about installing a traffic signal on Foothill Road in front of <br />Foothill High School or about extending the median on Foothill Road. Staff determined <br />that it was critical that the median island on Foothill Road be constructed and the street <br />widened to accommodate the left turn pocket into the High School. To accomplish this <br />goal, staff talked with the developer, DeNova Homes, which agreed to help the City meet <br />the construction deadlines by constructing these improvements along with Tract <br />improvements. Subsequently, a reimbursement agreement was drafted and approved by <br />the City Council on August 3, 2004. <br />All work is now complete and the developer is requesting reimbursement of the cost of <br />improvements. The developer has submitted all project invoices, which have been <br />reviewed and verified by City staff. Staff recommends payment to the developer, <br />DeNova Homes, in the amount of $68,427.52. <br />BUDGET <br />Council approved funding for the median island design and construction on June 18, <br />2002, with the Mid-Term Budget and Capital Improvement Program. The project budget <br />was set at $50,000.
