THE CITY OF <br />~,, <br />j~L~~S~4NTONe <br />February 6, 2007 <br />Public Works Department <br />TITLE: ACCEPT PUBLIC IMPROVEMENTS FROM DENOVA HOMES (MARDEL <br />LLC) ON FOOTHILL ROAD ADJACENT TO TRACT 7176 (LEMOINE <br />RANCH ESTATES) <br />SUMMARY <br />On September 19, 2006, City Council accepted Tract 7176, Lemoine Ranch Estates, <br />which is a 12-lot, single-family residential subdivision development located on the west <br />side of Foothill Road at Oak Creek Drive. A condition of approval required the developer <br />of the Lemoine Ranch Estates subdivision to construct a landscaped median island <br />across the frontage of this development and along the frontage of Foothill High School. <br />The condition states that the City will reimburse the developer for the cost of designing <br />and constructing the median island across the Foothill High School frontage. The <br />landscaped median island along the frontage of Foothill High School is now complete <br />and the developer is requesting acceptance of the public improvements. <br />RECOMMENDATION <br />Staff recommends that the City Council take the following action at the meeting of <br />February 6, 2007: <br />Accept for normal maintenance the street improvements installed by DeNova Homes <br />(Mardel LLC) on Foothill Road adjacent to the development. <br />2. Authorize the City Clerk to file a Notice of Completion. <br />3. Authorize final payment to DeNova Homes in the amount of $68,427.52. <br />4. Authorize transfer of funding from (CIP 045009) in the amount of $18,427.52. <br />FINANCIAL STATEMENT <br />The subject project will have an insignificant effect on yearly operating costs, as there is <br />a nominal amount of road and landscape added with this project. The funding source <br />used to cover this project deficit is residual funding from an annual replacement project <br />that had not been specifically appropriated for future use. <br />14 <br />CITY COUNCIL AGENDA REPORT <br />
