THE CITY OF ~,, j~L~~S~4NTONe February 6, 2007 Public Works Department TITLE: ACCEPT PUBLIC IMPROVEMENTS FROM DENOVA HOMES (MARDEL LLC) ON FOOTHILL ROAD ADJACENT TO TRACT 7176 (LEMOINE RANCH ESTATES) SUMMARY On September 19, 2006, City Council accepted Tract 7176, Lemoine Ranch Estates, which is a 12-lot, single-family residential subdivision development located on the west side of Foothill Road at Oak Creek Drive. A condition of approval required the developer of the Lemoine Ranch Estates subdivision to construct a landscaped median island across the frontage of this development and along the frontage of Foothill High School. The condition states that the City will reimburse the developer for the cost of designing and constructing the median island across the Foothill High School frontage. The landscaped median island along the frontage of Foothill High School is now complete and the developer is requesting acceptance of the public improvements. RECOMMENDATION Staff recommends that the City Council take the following action at the meeting of February 6, 2007: Accept for normal maintenance the street improvements installed by DeNova Homes (Mardel LLC) on Foothill Road adjacent to the development. 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize final payment to DeNova Homes in the amount of $68,427.52. 4. Authorize transfer of funding from (CIP 045009) in the amount of $18,427.52. FINANCIAL STATEMENT The subject project will have an insignificant effect on yearly operating costs, as there is a nominal amount of road and landscape added with this project. The funding source used to cover this project deficit is residual funding from an annual replacement project that had not been specifically appropriated for future use. 14 CITY COUNCIL AGENDA REPORT
