ATTACHMENT 1 THIRD AMENDMENT TO CONTRACT FOR CONSULTANT SERVICES This Third Amendment to Contract is entered into January 16, 2007 by the City of Pleasanton ("City") and Mundie & Associates ("Consultant"). Recitals. Whereas, on May 18,2004, the City and Mundie & Associates entered into Contract for Consultant Services concerning an Environmental Impact Report for Proposed PUD-33 (Oak Grove) Project ("Contract"), and Whereas, the Contract was first amended on April 22, 2006, City and Mundie& Associates entered into Contract for Consultant Services concerning an Environmental Impact Report for the Proposed PUD-33 (Oak Grove) Project ("Contract"), and Whereas, the Contract was second amended on July 18, 2006, City and Mundie& Associates entered into Contract for Consultant Services concerning an Environmental Impact Report for the Proposed PUD-33 (Oak Grove) Project ("Contract"), and Whereas, the parties now wish to expand the further scope of the services under the Contract to include as more fully described in the attached letter from the Consultant dated January 8, 2007. Whereas, the parties desire to amend the Contract. Now, therefore, the parties agree as follows: I. Consultant shall perform all the work identified in Exhibit B. The project manager of the work in Exhibit B shall be Roberta Mundie. Under this amendment, City shall pay Consultant an amount not to exceed $182,836. 2. All other terms and conditions of the Contract, as first and second amended, shall remain in full force and effect. In witness, whereof, authorized representatives of the parties have executed this Third Amendment to the Contract as of the date and year first above written.
