9 PLfASANTO}.l City Council Information Report January 16,2007 Department of Planning and Community Development SUBJECT: Approval of the Third Amendment to the Consultant Contract with Mundie & Associates to Prepare and Environmental Impact Report (EIR) for the Oak Grove PUD Development Plan (PUD-33) STAFF RECOMMENDATION: Authorize the City Manager to execute the third amendment to the contract for preparation of the Environmental Impact Report for the Oak Grove project with Mundie & Associates, Consultants in Land Use and Economics. SUMMARY: On May 18, 2004, the City Council authorized the City Manager to execute a contract with Mundie & Associates for consultant services concerning the preparation of an Environmental Impact Report (EIR) for the proposed Oak Grove development, PUD-33. The Draft EIR was published on June 30, 2006, and copies were distributed to the State Clearing House, Responsible Agencies, and interested parties. The cost to prepare the Draft EIR has exceeded the initial estimate and budget of $281,600 - plus two amendments for $21,000 and $105,000 - by $44,136, because of the project's complexity, technical analyses resulting from the project's evolving definition, and preparation of project alternatives including the environmentally preferred alternative. Additionally, the consultant has submitted a list of the work elements to prepare the Final EIR, including a cost estimate of$138,700. The project applicant has agreed to pay the increased costs.
