<br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br /> <br />PCUP-181, Michael Callahan <br />Ruby Hill Event Center and Winery <br />December 19, 2006 <br /> <br />1. Approval of this conditional use permit shall be contingent upon approval of the PUD <br />development modification, Case No. PUD-93-02-08M. <br /> <br />2. The proposed facility shall conform to the following hours of operations: <br /> <br />Sunday- Thursday: <br />Friday/Saturday, and the day <br />before a Federal holiday: <br /> <br />9:00 a.m. to 10:00 p.m. <br /> <br />9:00 a.m. to 11 :00 p.m. <br /> <br />Any outdoor-related events shall conclude by no later than 9:00 p.m. daily. Additional <br />hours and activities beyond that stated may be approved by the Planning Director if <br />found to be in substantial conformance with the approval. The Planning Director may <br />also refer the matter to the Planning Commission if the proposed changes would be <br />significant. <br /> <br />3. Valet parking shall be provided for any event anticipating patronage of 100 guests or <br />more and shall not block or impede any emergency vehicle access. <br /> <br />4. Upon receipt of notification from the City, the property owner/facility operator shall <br />implement a staggered event schedule between the existing Palm Event Center and the <br />proposed facility to mitigate traffic congestions on Vineyard Avenue. <br /> <br />5. Acoustic-only, non-amplified music /voice accompaniment, e.g. acoustic guitar or piano, <br />shall be allowed outside the building. A string quartet shall also be allowed to play <br />outside the building. Outdoor ceremonies shall take place no later than 9:00 p.m. <br />Amplified musical instruments and DJ's shall only allowed indoors. <br /> <br />6. No outdoor storage of wine-producing equipment shall be allowed in the area of the wine <br />production and barrel storage structures as further described in Exhibit A. No <br />wine-producing or event center equipment shall be stored outdoors of the event center <br />and wine tasting building. All mechanical equipment and machinery used for wine <br />production shall meet the following noise restrictions as required by the Noise <br />Ordinance: <br />. The noise level produced on the business premises between the hours of <br />10:00 p.m. and 6:00 a.m. shall not exceed 60 dBA at the property plane between <br />the residential zoning district and the commercial zoning district. <br />. The noise level produced on the business premises between the hours of <br />6:00 a.m. and 10:00 p.m. shall not exceed 70 dBA at any point outside of the <br />property plane. <br /> <br />The applicant shall provide written verification from an acoustic engineer certifying that <br />this requirement is satisfied prior to operation. Additional sound attenuation mitigation <br />may be required at the discretion of the Planning Director. <br />
