<br />ORDINANCE NO. 1945 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF DONALD BABBITTI HEARTWOOD <br />COMMUNITIES FOR PLANNED UNIT DEVELOPMENT MAJOR MODIFICAnON AND <br />DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PUD-99-07-o3M1PDR-579 <br /> <br />WHEREAS, Donald Babbitt/Heartwood Communities has applied for: (1) a major <br />modification to the approved Planned Unit Development (PUD) development plan for Tract 7162 <br />(formerly TTK Properties) to incorporate design guidelines for the development and to modify <br />the design review approval process; and (2) design review approval for the construction of an <br />approximately 7, 12a-square-foot two-story home with an approximately 1,66a-square-foot <br />garage and a 1 ,Oaa-square-foot basement to be located on Lot a, on the south side of Happy <br />Valley Road at its junction with Alisal Street in the Happy Valley Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-SRDR (Planned Unit Development - <br />Semi-Rural Density Residential) District; and <br /> <br />WHEREAS, the environmental review for this proposed project was undertaken with the <br />Final Environmental Impact Report (EIR) for the Happy Valley Specific Plan, approved by the <br />City Council on June 16, 199a, in conformance with the standards of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances <br />under which the project is being undertaken that involve new significant environmental effects or <br />that substantially increase the severity of previously identified effects; furthermore, there is no <br />new information of substantial importance which was unknown at the time that the Mitigated <br />Negative Declaration was approved by the City Council regarding the project or its effects, <br />mitigation measures, or alternatives; and any previously identified effects or impacts are <br />mitigated to a level of insignificance with the mitigation measures incorporated into the project's <br />design or imposed on the project pursuant to the conditions of approval; and <br /> <br />WHEREAS, at its meeting of October 1a, 2006, the Planning Commission <br />recommended approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on December 5, 2006; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with the <br />General Plan policies and the purposes of the PUD ordinance of the City of Pleasanton; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that <br />the proposed design review, as conditioned, is appropriate and is consistent with the zoning <br />regulations for the zoning district of the property. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />
