Resolution No. 92-217 <br />Page 2 <br /> <br />WHEREAS, <br /> <br />a final Supplemental Environmental Impact Report was <br />prepared and certified by the City Council prior to the <br />PUD for this site; therefore, no new environmental <br />document accompanies this report; and <br /> <br />WHEREAS, <br /> <br />the City Council makes the following findings for a 38- <br />lot subdivision: <br /> <br />The proposed map is consistent with the General <br />Plan. <br /> <br />The 38-1ot tentative map, which locates homes off <br />the hillside and at least 50 feet away from the toe <br />of the hillside, is consistent with the acceptable <br />risk policy stated in the Public Safety Element of <br />the General Plan. The 37 proposed new homes, and <br />utilities and roads serving those homes, are not <br />expected to be subjected to any seismic or <br />landslide induced hazards beyond that considered <br />"acceptable" by the General Plan. However, the <br />existing home, which is located within 50 feet of <br />the toe of the ancient landslide, may be subject to <br />a greater potential risk of damage than would be <br />considered "acceptable" by the General Plan. <br /> <br />The 38-1ot subdivision, with an overall density of <br />0.42 units per acre is consistent with the "Rural <br />Density Residential" and the "Low Density <br />Residential" land use designations of the site. <br />The proposed map generally is consistent overall <br />with the approved PUD plan and that part of the PUD <br />plan indicating lots on the flatter portion of the <br />site. The PUD was consistent with other General <br />Plan policies and programs when it was approved in <br />April 1992. <br /> <br />The site is physically suitable for this type of <br />development and density. <br /> <br />Two-thirds of the site is characterized by a <br />rolling and steep-sided hillside, while the eastern <br />one-third of the site is relatively flat. The 38- <br />lot development will occur on the flatter portion <br />of the site. The amount of grading proposed solely <br />for development of the site is limited. The street <br />system has been limited to that necessary only for <br />access into and through the site. An emergency <br />vehicle access road into the site from the <br />northeastern corner and a similar access which <br />traverses the open space portion of the site will <br />ensure proper emergency response for residents and <br />for the suppression of potential wildland fires. <br /> <br /> <br />
