Resolution No. 91-202 <br />Page Two <br />resolution, and with the terms and conditions of <br />the Growth Management Agreement authorized by this <br />resolution. <br />b. This resolution does not guarantee the availability <br />of sufficient sewage treatment capacity to serve <br />the project which has received growth management <br />approval. Building permits may be withheld if the <br />City determines that sewage treatment capacity is <br />not available at the time building permits for the <br />Project are applied for. <br />c. This resolution also does not guarantee the <br />availability of sufficient water to serve the <br />Project; building permits may be withheld if the <br />City determines that sufficient water, as evidenced <br />by mandatory rationing, is not available at the <br />time building permits for the Project are applied <br />for. <br />Section 5: Nothing herein shall lessen any obligation of the <br />developer required as a condition of any other approvals <br />granted by the City. <br />Section 6: The City Manager is hereby authorized to sign a Growth <br />Management Agreement with the property owners/developers <br />in order to carry out the terms and conditions of this <br />resolution. <br />Section 7: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON DECEMBER 10, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr, Scribner, Tarver, and <br />Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />ATTEST: <br />f <br />Pegg z dr City Clerk <br />APPROVED AS TO FORM: <br />Z~ /~ <br />Michael H.
