9133315'7 <br />Resolution No. 91-188 <br />Page Two <br />WHEREAS, although this Alignment Plan does not encroach into the <br />four parcels, the Plan does not account for landscaping <br />and sidewalk areas outside the adopted .paved road <br />section; and <br />WHEREAS, the west side of Foothill Road in this area is subject to <br />landslides and should the west side ever be developed, <br />the developer would be required either to repair the <br />landslides, construct costly retaining walls, or request <br />that Foothill Road be shifted to the east which would <br />impact and encroach on these parcels; and <br />WHEREAS, the Board of Directors of the Homeowners Association and <br />the adjacent property owners within the Foothill Knolls <br />Subdivision have requested that the City accept the open <br />offer of dedication as to these parcels at this time in <br />order to preserve the area for landscaping and/or <br />sidewalk area adjacent to Foothill Road; and <br />WHEREAS, based on substantial evidence, City Council is satisfied <br />that the parcels may be necessary for landscaping and <br />sidewalk areas adjacent to Foothill Road as realigned or <br />may be necessary for Foothill Road itself if it is deemed <br />necessary to shift the road to the east. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: The City Council hereby accepts the open offer of <br />dedication of Parcels A, B, C and D of Tract 4768, more <br />particularly described on Exhibit "A", attached hereto <br />and incorporated herein by this reference. <br />Section 2: The City Clerk is directed to cause a certified copy of <br />this resolution to be recorded with the Alameda County <br />Recorder's Office. <br />Section 3: This resolution shall become effective immediately <br />upon its passage and adoption. <br />Th!S ir~il'1.i=~r?~;~+ F~.~d err rer_ord by <br />Pdt~ri' ,~:~~~,~~ Pr'ic ~,~~r~;r~r~n}~ of Alameda <br />~.'OUi;~t,'~ ~~ ~ e^'.Il _,~~,:';;iii~d:;'}IU11 Only.
