Bo~~ s 2 0 ~133315~ <br />t~l~~-::~ancon C~~ 9~'S6~ <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />5~5~ <br />RESOLUTION NO. 91-188 <br />RESOLUTION ACCEPTING OPEN OFFER OF DEDICATION <br />OF PARCELS A, B, C AND D, TRACT 4768 <br />WHEREAS, when the first phase of the Foothill Knolls subdivision <br />(PUD-81-07, Tract 4768) was approved, one of the <br />conditions of approval was that the developer make a non- <br />revokable offer of dedication to the City with respect to <br />property adjacent to Foothill Road, to be designated as <br />"Foothill Road right-of-way"; and <br />WHEREAS, the condition further provided that the right-of-way was <br />intended to accommodate four travel lanes and that until <br />this offer of this property was accepted by the City, the <br />property would be part of the adjacent lots and under the <br />control and maintenance of these lot owners; and <br />WHEREAS, when the final map for this Tract was recorded, this <br />property was designated on the subdivision map as Parcels <br />A, B, C and D and was labeled "Foothill Road Reserve"; <br />and <br />WHEREAS, the final map stated that the developer made an open <br />offer of dedication to the City with regard to these four <br />parcels, but the offer of dedication of the parcels was <br />not accepted by the City at that time; and <br />WHEREAS, since that time, the four parcels have been maintained <br />either by the adjacent property owners to the east or by <br />the Foothill Knolls Homeowners Association; and <br />WHEREAS, unbeknownst to the City or to the Homeowners Association, <br />the Alameda County Tax Assessor's Office assessed Parcels <br />B and C; and <br />WHEREAS, also unbeknownst to the City or to the Homeowners <br />Association, the real property taxes on Parcels B and C <br />were not paid and the two parcels were sold by the County <br />for delinquent taxes in July, 1991; and <br />WHEREAS, earlier in 1991, the City Council adopted a new Foothill <br />Road Alignment Plan setting in general terms the street <br />width and alignment of Foothill Road; and <br />WHEREAS, in this area where the four parcels in question are <br />located, the Plan shows the curb to curb width of <br />Foothill Road to be 50 feet, with one travel lane and <br />bicycle lane in each direction, plus a turning <br />lane/landscaped island; and <br />
