Resolution No. PC-89-80 <br />September 27, 1989 - Page <br />B• That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />The proposed operation is sufficiently setback from <br />the neighboring residential area and completely <br />contained on-site with sufficient parking and <br />traffic capacity. The proposed branch, as <br />conditioned below, would not have any adverse <br />effects on surrounding residential areas and <br />businesses, but rather would contribute to the <br />economic vitality, convenience and diversity of the <br />area. <br />C• That the proposed conditional use will comply with <br />each of the applicable provisions of the Municipal <br />Code. <br />The site's PUD I/C-O zoning allows the <br />establishment of financial institution upon the <br />granting of a conditional use permit in accordance <br />with the provisions of Chapter 18.124. The <br />pertinent city requirements for parking, loading <br />and setbacks have also been met, and that the use <br />conforms to the City's financial institution <br />policy. <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental Quality <br />Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-8g-47~ the application of California <br />Federal Bank for a conditional use permit to operate a <br />branch bank to be located a 4811 Hopyard Road subject to <br />the following conditions: <br />1• That the proposed use shall conform substantially <br />to the site plan, elevations and related <br />materials, Exhibit A (dated June 15, 1989) on file <br />with the Planning Department. <br />2• That if, at any time in the future, the Planning <br />Director finds the presence of the branch office <br />interferes with the parking, circulation, or <br />operation of adjacent businesses, to the detriment <br />of the surrounding uses or to the City in general, <br />the Planning Director may refer this matter to the <br />Planning Commission which may review the subject <br />use permit and, if necessary, revoke it or attach <br />additional conditions of operation. <br />
