environmental damage or substantially and avoidably <br />injure fish or wildlife or their habitat. <br />A negative declaration was adopted prior to this <br />subdivision application in conjunction with the <br />project PUD approval, because it was determined <br />that the project would not create significant <br />environmental impacts. As a part of the project <br />initial study, no waterways, or wildlife habitat <br />were identified on the site. <br />4. The design of the subdivision is not likely to <br />cause serious public health problems <br />The subdivision application is for the creation of <br />28 single family homes. All public services, <br />including water, sewer and storm drainage are <br />included within the scope of the project. <br />5. The design of the subdivision or its related <br />improvements will not conflict with easements, <br />acquired by the public at large, for access through <br />or use of, property within the proposed <br />subdivision. <br />The design of the subdivision includes street <br />right-of-way dedications to provide for planned <br />public access across the property. Public access <br />across the property will now occur on new public <br />streets developed at the time of the residential <br />development. There were no public easements <br />recorded across the project that require <br />abandonment as part of the subdivision. <br />WHEREAS, a Negative Declaration was approved by the City Council <br />in conjunction with the PUD development plan review for <br />this project; therefore, no additional environmental <br />analysis was prepared for the tentative map <br />application. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Tract 6160, the application to subdivide an <br />approximately 10 acre site into a 28 lot single-family <br />residential project proposed to be located at 5137 <br />Foothill Road subject to the conditions shown on Exhibit <br />"A" attached hereto and made part of this case by <br />reference . <br />Section 2. This resolution shall become effective <br />15 days after its passage and adoption. <br />
