AGREEMENT <br />FOR THE EXCHANGE OF REAL PROPERTY <br />THIS AGREEMENT dated this day of <br />19 , is by and between the Pleasanton Unified <br />School District, a public school district organized under the laws <br />of the State of California ("the District") and the City of <br />Pleasanton, a general law city in and of the State of California <br />("the City"). <br />RECITALS <br />WHEREAS, District is the record owner of certain real <br /> property in the City of Pleasanton, more <br /> particularly described in Exhibits . "A" and "B" <br /> attached hereto and incorporated herein by <br /> reference; and <br />WHEREAS, City is the record owner of certain real <br /> property in the City of Pleasanton, More <br /> particularly described in Exhibit "C <br />" <br /> , <br />attached hereto and incorporated herein by <br /> reference; and <br />WHEREAS, District desires property for public and <br /> institutional purposes, including the <br /> construction of a corporation yard and certain <br /> kitchen facilities; and <br />WHEREAS, City desires property to meet existing and <br /> future recreational and park needs of the <br /> community; and <br />WHEREAS, District owns certain property, which it has <br /> designated as surplus property; and <br />WHEREAS, District desires to develop such surplus <br /> property in Qrder to provide an income stream <br /> to itself; and <br />WHEREAS, District has requested from the City <br /> assurances that such surplus property, if <br /> approved by the City for residential <br /> development, will be granted growth management <br /> approval pursuant to the City's Growth <br /> Management Program Ordinances; and <br />WHEREAS, City is willing, by this Agreement and by <br /> appropriate amendments to the Growth <br /> Management Program Ordinance, to grant such <br /> assurances to the District in order to provide <br /> an income stream to the District. <br />
