PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-75 <br />RESOLUTION APPROVING CASE UP-89-43, APPLICATION OF <br />GARDEN-WEST <br />WHEREAS, Carden-West has applied for a conditional use permit for <br />the Carden-West School to operate a kindergarten through <br />third grade elementary school with extended day care <br />facility within an existing building located at 4444 <br />Black Avenue; and <br />WHEREAS, zoning for the property is "P" (Public and <br />Institutional) District; and <br />WHEREAS, at their duly noticed public hearing of August 23, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits, and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use is <br />in accordance with the objectives of Chapter 18 and <br />the purposes of the district in which the site is <br />located. <br />The site is on Black Avenue in an area zoned "P" <br />(Public and Institutional) District. The intent of <br />this zone is to provide for the orderly <br />establishments of public and quasi-public <br />institutional uses. The Carden-West School provides <br />the only private non-parochial school in the <br />Pleasanton area. <br />B. That the proposed conditional use will comply with <br />each of the applicable provisions of the Zoning <br />Ordinance. <br />The conditional use will comply with all applicable <br />provisions of the Zoning Ordinance, Chapter 18 of <br />the Municipal Code regarding parking and use. <br />C. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental the public <br />health, safety or welfare, or materially injurious <br />to the properties or improvements in the vicinity; <br />
