C. That the proposed conditional use will comply with <br />each of the applicable provisions of the ordinance <br />code. <br />The sites c-C zoning allows the establishment of <br />restaurants. The subject restaurant complies with <br />all relevant and applicable sections of the zoning <br />ordinance. The granting of a conditional use <br />permit to allow for alcoholic beverages service <br />after 10:OOpm is consistent with the City's ability <br />to regulate zoning as listed in the objectives of <br />Chapter 18.124 (Conditional Uses). The subject <br />application (with requisite data, maps, and fees) <br />complies with the applicable sections of Chapter <br />18.124. <br />WHEREAS, minor alterations in land use limitations are <br />categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-89-37, application of Ray <br />Bartolomucci for a conditional use permit to operate a <br />restaurant where alcoholic beverages would be served <br />after 10:00pm to be located at 649 Main Street subject <br />to the following conditions: <br />1. That the location and operation of the use shall <br />conform substantially to the site plan, floor plan, <br />and details of operation, dated June 16 and July 7, <br />1989, on file with the Planning Department. In the <br />event that the alcoholic beverage service is <br />expanded significantly in the future, the Planning <br />Commission may review and, if necessary, apply <br />additional conditions to the subject use permit. <br />2. That the proposed use shall be operated only in <br />conjunction with a full-service restaurant. <br />3. That if, at any time in the future, the activities <br />of the operation deviate from the above description <br />or the ownership and/or management of the <br />restaurant are unable to control the activities of <br />patrons such that the presence of the restaurant <br />encourages loud noises, litter, traffic problems, <br />drunkenness, etc., to the detriment of the <br />surrounding uses or to the City in general, the <br />Planning Commission may review and, if necessary, <br />revoke the subject conditional use permit. <br />
