PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-71 <br />RESOLUTION APPROVING CASE UP-89-37, APPLICATION OF RAY <br />BARTOLOMUCCI FOR A CONDITIONAL USE PERMIT <br />WHEREAS, Ray Bartolomucci has applied for a conditional use <br />permit to operate a restaurant at 649 Main Street where <br />alcoholic beverages would be served after 10:OOpm; and <br />WHEREAS, zoning for the property is C-C (Central Commercial) - <br />Downtown Revitalization District; and <br />WHEREAS, at their duly noticed public hearing of July 12, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />The subject site is located in the C-C (Central <br />Commercial) District. Restaurants are a permitted <br />use in the C-C District and are in accordance with <br />General Plan goals in encouraging specialty uses in <br />the downtown area. As liquor service is considered <br />an integral part of dining, the use permit would be <br />in accordance with these objectives. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />The proposed restaurant's alcoholic beverage <br />service will be completely contained on-site and <br />will be ancillary to the main restaurant use. The <br />use is located in an area where nighttime use would <br />create no nuisance to adjoining uses. The <br />conditions of approval will ensure maintenance of <br />the proposed establishment within all applicable <br />City codes (loitering, litter, noise, etc.). Other <br />restaurant/bar operations satisfactorily operate in <br />similar locations in the downtown. <br />
