PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION N0. PC-89-71 RESOLUTION APPROVING CASE UP-89-37, APPLICATION OF RAY BARTOLOMUCCI FOR A CONDITIONAL USE PERMIT WHEREAS, Ray Bartolomucci has applied for a conditional use permit to operate a restaurant at 649 Main Street where alcoholic beverages would be served after 10:OOpm; and WHEREAS, zoning for the property is C-C (Central Commercial) - Downtown Revitalization District; and WHEREAS, at their duly noticed public hearing of July 12, 1989, the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission made the following findings: A. That the proposed location of the conditional use is in accordance with the objectives of the zoning ordinance and the purpose of the district in which the site is located. The subject site is located in the C-C (Central Commercial) District. Restaurants are a permitted use in the C-C District and are in accordance with General Plan goals in encouraging specialty uses in the downtown area. As liquor service is considered an integral part of dining, the use permit would be in accordance with these objectives. B. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed restaurant's alcoholic beverage service will be completely contained on-site and will be ancillary to the main restaurant use. The use is located in an area where nighttime use would create no nuisance to adjoining uses. The conditions of approval will ensure maintenance of the proposed establishment within all applicable City codes (loitering, litter, noise, etc.). Other restaurant/bar operations satisfactorily operate in similar locations in the downtown.
