PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-67 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR CASE <br />UP-89-33, THE APPLICATION OF SERENE CHAN <br />WHEREAS, Serene Chan has applied for a conditional use permit to <br />operate a veterinarian office and small animal hospital <br />where all operations are to be conducted entirely within <br />an enclosed building to be located at 243-C Main Street; <br />and <br />WHEREAS, zoning for the property is C-C (Central Commercial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of June 14, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />One of the objectives of the zoning ordinance is to <br />ensure that public and private lands are used for <br />purposes which are most beneficial to the City as a <br />whole. This objective was modified and adopted as <br />a land use policy for the Downtown Specific Plan, <br />which emphasizes the need "to increase the amount <br />of commercial space and to attract more customers", <br />and "to increase the amount of office space to <br />provide daytime patronage of retail stores, <br />services and restaurants." As conditioned, the <br />proposed use is a service that would provide a <br />beneficial service to a community with domestic <br />animals, and would contribute to daytime patronage <br />in the downtown area. Because the proposed use <br />would fill vacant commercial space downtown, the <br />proposed use meets the C-C (Central Commercial) <br />district's purpose of encouraging more intensive <br />development in the central business district. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
