That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to the properties or improvement sin the vicinity. The proposed gymnastics school facility will not have an adverse impact on surrounding properties due to the small scale of the use and performance standards included as conditions of approval. Also, adequate parking is available to prevent encroachment onto neighboring tenants and properties. C. That the proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. That the proposed conditional use complies with all applicable provisions of the Zoning Ordinance, Chapter 18 of the Municipal Code, regarding parking, loading, and noise levels; and WHEREAS, the Planning Commission found that conditional use permits for minor land use regulations are exempt from the requirements of CEQA (the California Environmental Quality Act). NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves Case UP-89-29, the application of B & B Gymnastics for a conditional use permit to operate a private recreation facility for children gymnastics instruction to be located at 1249 within an existing light industrial building subject to the conditions shown on Exhibit "A" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption.
