Resolution No. PC-89-63 <br />May 24, 1989 - Page 2 <br />The proposed Round Table alcoholic beverage service <br />will be completely contained on-site and will <br />generate minimal impacts on surrounding properties. <br />Sufficient parking, traffic capacity, and setbacks <br />from residential neighborhoods have been provided <br />and will accommodate the proposed use. The use is <br />located in an area where nighttime use would create <br />no nuisance to adjoining uses. The conditions of <br />approval will ensure maintenance of the proposed <br />establishment within all applicable City codes <br />(loitering, litter, noise, etc.). Other <br />restaurant/bar operations satisfactorily operate in <br />similar locations in the City. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br />The site's PUD zoning allows the establishment of <br />restaurants. The subject restaurant complies with <br />all relevant and applicable sections of the zoning <br />ordinance. The granting of a conditional use <br />permit to Round Table for alcoholic beverage <br />service after 10:00 p.m. is consistent with the <br />City's ability to regulate zoning as listed in the <br />objectives of Chapter 18.124 (Conditional Uses). <br />The subject application (with requisite data, maps, <br />and fees) complies with the applicable sections of <br />Chapter 18.124. <br />WHEREAS, minor alterations in land use limitations are <br />categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA). <br />WHEREAS, the Planning Commission finds that this conditional use <br />permit is consistent with the zoning district and <br />General Plan policies of the City of Pleasanton. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves the application for a conditional use permit <br />to serve alcoholic beverages for on-site consumption <br />past the hour of 10:00 p.m. at a restaurant proposed to <br />be located at 4855-C Hopyard Road subject to the <br />conditions shown on Exhibit "A" attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective <br />15 days after the date of its passage and adoption. <br />
